What is covered?

Almost all businesses are exposed to the risk of liability claims. AIG in the Philippines offers tailored-solutions to various industries. This includes products tailor fit for oil and gas service contractors, food and beverage operators, Business Process Outsourcing services (BPO), and hotels and resorts, and conventions. OSCAR is a liability insurance coverage specifically designed for oil and gas service contractors that provide services to production sharing contractors, operators or drilling and support contractors. This program offers coverage for both onshore and offshore locations. AIG offers two broad categories of coverage: Public and Products Liability; and Worker’s Compensation and Employer’s Liability.

F&B Express is designed for manufacturers, distributors, retail and wholesalers of food and beverage products with annual sales turnover of not more than USD5,000,000. This program includes Public Liability, Products Liability and sub-limited Product Recall Extension.

BPO Express is designed for business process outsourcing operations that cater to multinational clients. This program includes Public Liability, Employer’s Liability and Excess Automobile Liability.

H-Express is a comprehensive solution specially designed for owners, operators and managers of Philippine domiciled hotels and resorts. This program includes, but is not limited to, Public Liability, Products Liability, Excess Automobile Liability and Innkeeper’s Liability.

RSVP is a Public Liability solution for event organizers to cover indoor and outdoor events. It is an insurance solution that covers third party bodily injury and property damage during events including ingress and egress activities. Optional enhancements to the cover include Food Poisoning Liability, Products liability, Employer’s Liability, and Contractor’s Liability.

The Insured must:

•          Give immediate notice to the Company with full particulars which includes copies of incident report, summons / complaint and other pertinent documents;

•          Act as prudently uninsured and take all steps within its power to minimize the loss or damage;

•          In all instances, never admit nor repudiate liability, negotiate or make any admission, offer promises or payment in connection with any incident or accident or claim without the written prior consent of the Company.

•          Cooperate with the authorized representative of the Company in the conduct of investigation.

•          Allow the Company to have complete control in the conduct of negotiation and settlement of any claim.

•          Refer all letters and communications to the Company without either admitting liability or attempting to repudiate.

Documents to be submitted:

•          A brief written report or affidavit of accident stating the circumstances of the loss including the name of person/s who first discovered the incident and person/s involved;

In event of Third Party Property Damage Claim:

o          Complaint/demand letter

o          Incident/security report /police report

o          Pictures of the damaged property

o          Estimate of repair/reinstatement/replacement

o          Additional documents that may be requested as the need arises

In event of third party bodily injury claim:

o          Incident/security report

o          Complaint/demand letter, if any

o          Medical report/abstract/certificate

o          Doctor’s prescription, hospital or medical service provider’s statement of account, medical invoices/official receipt of payment

o          Additional documents that may be requested as the need arises

In event of third party death claim – in additional to the above-mentioned documents, the following are required:

o          Death certificate

o          Post mortem report

o          Burial Permit/Certificate

o          Invoices and/or official receipts to support the burial expenses incurred

o          Additional documents that may be requested as the need arises

Important Note:

•          Incident or circumstance that may potentially develop into  Employer’s Liability, Contaminated Product Insurance and Environmental Impairment Liability claim should be notified to us as soon it is known to the insured so we can  immediately engage an expert and/ or adjuster.

Points to consider:

•          Casualty Insurance Policy cover is triggered by occurrence of third party bodily injury and/or third party property damage.

•          In case an occurrence is considered a covered claim, the defense cost is also triggered; subject to the Policy’s Terms and Conditions.

How claim is settled?

•          Settlements are usually based on the actual cost incurred in the treatment of third party bodily injury or cost of repair/reinstatement of damaged third party property to its original state prior to the incident.

•          Financial loss suffered by a third party following an occurrence, subject to presentation of relevant documents

•          Awards and/or consequential consideration as ordered by the Court, excluding uninsurable award/s.

•          Any award/compensation/settlement agreed by all parties.
